Description

Additional Anishinabek Nation First Nations have expressed interest in conducting Community Approval Processes (ratification) to determine whether they will join the Anishinabek Nation Governance Agreement as parties. If these processes yield positive results, the First Nations must be formally added as parties to the agreement and included in the Schedule to the Anishinabek Nation Governance Agreement Act.

To maintain consistency between the agreement and the legislation, the Anishinabek Nation Governance Agreement Act must be updated to reflect the inclusion of these additional First Nations.

Regulatory cooperation efforts (domestic and international)

Chapter 11 of the Anishinabek Nation Governance Agreement defines the relationship of laws enacted under the agreement and federal laws, including Canada's international legal obligations.

Laws established by each First Nation and the Anishinabek Nation under the agreement operate concurrently with federal and provincial laws. However, they do not apply to matters not expressly addressed in the agreement, such as criminal law and procedure, labour relations and working conditions, intellectual property, aeronautics, navigation and shipping, or Canada's official languages.

Potential impacts on Canadians, including business

There is a very limited population who will be impacted by this amendment, specifically the Anishinabek First Nations who are already parties to the Anishinabek Nation Governance Agreement, Anishinabek Nation First Nations who would be joining as parties to the Agreement (subject to positive Community Approval Processes), and B'Maakonigan (the Anishinabek Nation Government, pursuant to the Anishinabek Nation Governance Agreement).

There are no associated costs or administrative burden for small businesses.

Consultations

Before proposing an amendment to the Anishinabek Nation Governance Agreement Act, consultations will be carried out with any affected First Nations.

Amending the Anishinabek Nation Governance Agreement to add additional First Nations as parties will be a decision made at the request of the interested Anishinabek First Nations and B'Maakonigan. Consultations with impacted First Nations will be led by First Nations partners pursuant to the Community Approval Protocol in the Anishinabek Nation Governance Agreement. A decision will not be made to proceed with amending the Anishinabek Nation Governance Agreement or the act to add the additional First Nations until receiving confirmation of support from the First Nations communities and from B'Maakonigan.

The order to amend the act will ensure consistency with the amendment to the Anishinabek Nation Governance Agreement, and the recommendations of First Nations partners will be reflected in the order.

This is "opt-in" legislation, in that amendments to add First Nations to the Anishinabek Nation Governance Agreement and to add them to the schedule of the act are done at the request of interested First Nations.
