Description
Additional Anishinabek Nation First Nations have expressed interest in conducting ratification processes to determine whether they will join the Anishinabek Nation Education Agreement as parties. If these processes yield positive results, the First Nations must be formally added as parties to the agreement and included in the Schedule to the Anishinabek Nation Education Agreement Act.
To ensure consistency between the agreement and the legislation, the Anishinabek Nation Education Agreement Act must be updated to reflect the inclusion of these additional First Nations.
Regulatory cooperation efforts (domestic and international)
Chapter 12 of the Anishinabek Nation Education Agreement defines the relationship between laws enacted under the agreement and federal laws, including Canada's international legal obligations.
Laws enacted by each First Nation and the Anishinabek Nation under the agreement operate concurrently with federal and provincial laws. However, they do not apply to matters not expressly addressed in the agreement, such as criminal law and procedure, labour relations and working conditions, intellectual property, aeronautics, navigation and shipping, or Canada's official languages.
Potential impacts on Canadians, including business
There is a very limited population who will be impacted by this amendment, specifically the Anishinabek Nation First Nations who are already parties to the Anishinabek Nation Education Agreement, Anishinabek Nation First Nations who would be joining as parties to the Anishinabek Nation Education Agreement (subject to positive ratification processes), and the Kinoomaadziwin Education Body (the governing body created by the Anishinabek Nation Education Agreement to represent the Participating First Nations).
There are no associated costs or administrative burden for small businesses.
Consultations
Before proposing an amendment to the Anishinabek Nation Education Agreement Act, consultations will be conducted with any affected First Nations.
The decision to amend the Anishinabek Nation Education Agreement to include additional First Nations as parties will be made at the request of the interested Anishinabek Nation First Nations and the Kinoomaadziwin Education Body. Consultations with impacted First Nations will be led by First Nations partners. No amendment to the agreement or the Act will proceed until confirmation of support is received from the affected First Nations communities and the Kinoomaadziwin Education Body.
The order to amend the act will align with the amendment to the Anishinabek Nation Education Agreement and will reflect the recommendations of First Nations partners.
This is "opt-in" legislation, meaning that amendments to include additional First Nations in the agreement and to update the schedule of the act are made only at the request of the interested First Nations.
